Tabled in the House of Commons on June 3, <strong>Bill C-2, An Act respecting certain measures relating to the security of the border between Canada and the United States and respecting other related security measures<\/strong>, marks one of the most significant proposed reforms to Canadian refugee law in recent years.<\/p>\n\n\n\n<p>If passed, <strong>Bill C-2<\/strong> would implement several sweeping changes to the current refugee protection framework, particularly affecting individuals who enter Canada irregularly or delay filing their asylum claims.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">Key Provisions of Bill C-2<\/mark><\/strong><\/h3>\n\n\n\n<p>Under the bill&#8217;s provisions:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Asylum Claims Time Limit:<\/strong> Any foreign national who entered Canada on or after <strong>June 24, 2020<\/strong>, would become <strong>ineligible to apply for refugee protection if they make a claim more than one year after their date of entry<\/strong>.<\/li>\n\n\n\n<li><strong>Irregular Crossings at the US Border:<\/strong> Individuals who cross the <strong>Canada\u2013US land border at non-official points of entry<\/strong> (i.e., irregularly) would <strong>no longer be eligible to claim asylum<\/strong>, regardless of how long they have been in the country.\n<ul class=\"wp-block-list\">\n<li>Under current law, such claimants are permitted to apply if they wait 14 days after arrival. This provision would <strong>eliminate that 14-day exception<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p>The bill&#8217;s restrictions would apply <strong>retroactively<\/strong>, meaning <strong>asylum claims submitted after June 3, 2025<\/strong> (the date of first reading), would be subject to the new rules.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">Expanded Executive Powers<\/mark><\/strong><\/h3>\n\n\n\n<p>In addition to tightening eligibility, Bill C-2 would <strong>grant the federal government broad discretionary powers<\/strong>. These include the authority for the Governor in Council (the federal Cabinet) to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Suspend, cancel, or reject certain immigration applications<\/strong> deemed not in the public interest;<\/li>\n\n\n\n<li><strong>Terminate the processing of immigration documents<\/strong>, or change their terms and conditions;<\/li>\n\n\n\n<li><strong>Require foreign nationals to appear for interviews or examinations<\/strong> by immigration authorities at any time;<\/li>\n\n\n\n<li><strong>Increase information-sharing<\/strong>, permitting more extensive <strong>disclosure of personal data<\/strong> to other federal departments or agencies.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">What Comes Next?<\/mark><\/strong><\/h3>\n\n\n\n<p>As of June 3, Bill C-2 has passed its <strong>first reading<\/strong> in Parliament. In order to become law, it must go through <strong>second and third readings<\/strong>, a <strong>Senate review<\/strong>, and then receive <strong>royal assent<\/strong>.
