While the official start date is yet to be announced, <strong>implementation is expected by late 2025<\/strong>.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">Who Will Be Required to Pay the $250 Fee?<\/mark><\/strong><\/h3>\n\n\n\n<p>According to the legislation, the <strong>Visa Integrity Fee applies to \u201cany alien issued a non-immigrant visa.\u201d<\/strong> This includes individuals applying under the following visa categories:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>B-1\/B-2 (Business\/Tourist)<\/strong><\/li>\n\n\n\n<li><strong>F\/M (Student)<\/strong><\/li>\n\n\n\n<li><strong>J (Exchange Visitor)<\/strong><\/li>\n\n\n\n<li><strong>H-1B\/H-4 (Temporary Workers and Dependents)<\/strong><\/li>\n\n\n\n<li><strong>Other employment-based and temporary classifications<\/strong><\/li>\n<\/ul>\n\n\n\n<p>Foreign nationals from <strong>non-waiver countries<\/strong>\u2014such as <strong>India, China, Nigeria, Pakistan, and Brazil<\/strong>\u2014will need to pay this fee <strong>in addition to existing application costs<\/strong>.<\/p>\n\n\n\n<p>This also applies to <strong>Canadian permanent residents and temporary residents<\/strong> holding citizenship from these countries, even if applying from within Canada.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\"><strong>Are Canadian Citizens Affected?<\/strong><\/mark><\/h3>\n\n\n\n<p>Most Canadian citizens are <strong>exempt from U.S. visa requirements<\/strong> for short-term travel, and therefore <strong>will not be required to pay<\/strong> the new fee. However, exceptions apply.<\/p>\n\n\n\n<p>Canadian citizens <strong>must still obtain U.S. non-immigrant visas<\/strong> (and pay the $250 fee) in the following cases:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>H-1B work visa or F-1 student visa<\/li>\n\n\n\n<li>Treaty trader\/investor (E-1\/E-2)<\/li>\n\n\n\n<li>K-1 (fianc\u00e9\/fianc\u00e9e of U.S. citizen)<\/li>\n\n\n\n<li>Diplomatic and official travel (A, G, NATO visas)<\/li>\n\n\n\n<li>S-visas (informants assisting U.S. law enforcement)<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">Who Is Exempt from the Fee?<\/mark><\/strong><\/h3>\n\n\n\n<p>The new fee <strong>does not apply to travelers entering the U.S. without a visa<\/strong>, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Citizens of Visa Waiver Program (VWP) countries<\/strong><\/li>\n\n\n\n<li><strong>Most Canadian tourists and business travelers<\/strong><\/li>\n<\/ul>\n\n\n\n<p><strong>List of VWP countries includes:<\/strong> Germany, Australia, Japan, France, South Korea, the U.K., and over 35 others.<\/p>\n\n\n\n<p><em>Note: Although Canada is not part of the VWP, its citizens benefit from separate visa-exempt arrangements.<\/em><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">Is the $250 Fee Refundable?<\/mark><\/strong><\/h3>\n\n\n\n<p>The law clearly states: <strong>no waivers or reductions<\/strong> will be granted. However, <strong>a reimbursement may be possible<\/strong> under specific conditions:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The visa holder <strong>complies with all visa terms<\/strong> (e.g., no unauthorized work)<\/li>\n\n\n\n<li>Leaves the U.S. <strong>within five days of visa expiration<\/strong><\/li>\n\n\n\n<li>Does not request extensions unless adjusting to <strong>permanent residency<\/strong><\/li>\n<\/ul>\n\n\n\n<p><strong>Applicants must apply to the Department of Homeland Security<\/strong> for reimbursement.
