New Rules Tighten Eligibility for Open Work Permits in Canada: What You Need to Know

Canada’s Immigration, Refugees and Citizenship Canada (IRCC) introduced significant changes to its Open Work Permit (OWP) program effective January 2025, reshaping the landscape for foreign nationals—especially spouses and dependents of international students and temporary foreign workers.

The move, according to the government, is designed to prioritize skilled labor, align with Canada’s economic needs, and manage population growth more effectively by tightening access to work permits.

What Is an Open Work Permit?

An Open Work Permit (OWP) allows foreign nationals to work for any employer across Canada without needing a specific job offer or a Labour Market Impact Assessment (LMIA).

Key benefits:

  • Work in any job, sector, or province
  • No need for an employer-specific contract
  • Eligible for up to 40 hours per week of work

But with the 2025 updates, access to these permits is now more selective and streamlined.


Who Can Still Apply for an Open Work Permit in 2025?

The updated eligibility categories include:

1. Post-Graduation Work Permit (PGWP) Holders

  • Must be 18+ and have completed a full-time program (minimum 8 months)
  • Program must be at a Designated Learning Institution (DLI)

2. Spouses of International Students

  • The student must be in one of the following programs:
    • Master’s (min. 16 months)
    • PhD
    • Select professional programs (e.g., law, medicine, engineering)
  • The spouse must not be a full-time student themselves

3. Spouses of Skilled Foreign Workers

  • The worker must be in a TEER 0 or 1 occupation (highly skilled)
  • Or a select TEER 2 or 3 job in high-demand sectors:
    • Healthcare, construction, education, natural sciences
  • The foreign worker’s permit must be valid for at least 16 months

4. Permanent Residence (PR) Applicants

  • PR applicants already living in Canada can apply for a Bridging Open Work Permit (BOWP)
  • Spouses of inland PR applicants are also eligible

5. Other Eligible Groups

  • Refugees and asylum seekers
  • International Experience Canada (IEC) youth (18–35 depending on nationality)
  • Workers facing abuse or mistreatment on an employer-specific permit
  • Destitute students

Who Is No Longer Eligible?

As of January 21, 2025:

  • Dependent children of international students and foreign workers can no longer apply for OWPs
  • They can still apply for study permits or other visa types
  • Existing OWP holders can retain or renew their permits under strict conditions

How to Apply for an Open Work Permit in 2025

  1. Check eligibility based on new rules
  2. Prepare documents:
    • Valid passport
    • Relationship proof (e.g., marriage certificate)
    • Partner’s work/study permit
    • Proof of enrollment or employment
