Canadian citizens and permanent residents can apply to sponsor their spouse, common-law partner, or conjugal partner for permanent residence (PR) in Canada. While the process may seem straightforward, there are various complexities involved. Couples may encounter delays or even refusals. 2. Eligibility to Sponsor Your Spouse or Partner

Requirements for Sponsors

To be eligible to sponsor a spouse, common-law, or conjugal partner for Canadian immigration, you must meet the following criteria:

  • Be at least 18 years old.
  • Be a Canadian citizen, permanent resident, or registered Indian.
  • Reside in Canada, or if you live abroad, provide evidence that you will return to Canada once your spouse is granted PR status.
  • Be willing to sign an undertaking to provide financial support to your spouse or partner for their basic needs for three years after they receive PR status.
  • Not be in any ineligible situations (as listed below).

Who Cannot Sponsor Their Spouse or Partner

You will be ineligible to sponsor your spouse or partner under certain circumstances, such as:

  • You were sponsored by a spouse or partner in the last five years.
  • You have failed to fulfill a previous sponsorship undertaking.

3. Who Can Be Sponsored for Canadian Immigration?

Relationship Types

  2. Common-law Partner
    An individual who has lived together with their partner in a conjugal relationship for at least one year, sharing the same home and supporting each other financially and emotionally.
  3. Conjugal Partner
    A partner who has been in a committed conjugal relationship for at least one year but cannot live together or marry due to external factors like immigration restrictions or cultural barriers.

  • Spouse: The marriage must be legally valid in the country where it occurred and recognized by Canadian law.
